Apstrakt

Veštačka inteligencija od nedavno intenzivno pomera granice razvoja ljudske civilizacije i tehnološkog razvoja. Kao tehnološko dostignuće, ona se neprimetno ,,ušunjala“ u život svakog pojedinca i postala sastavni deo svih sfera društvenog života. U primeni veštačke inteligencije danas kao da ne možemo da se otmemo utusku da ono što je u jednom trenutku izgledalo moguće za sto godina, u stvari je postalo realnost u poslednjih desetak godina. Potreba za pravnom regulucijom i zakonskim uređenjem korišćenja veštačke intiligencije se nameće kao važno pitanje za njen budući razvoj u korist ljudske zajednice i celokupnog čovečanstva. Ovo istraživanje je deo šire slike o potencijalnoj upotrebi veštačke inteligencije u pojedinim granama prava, usmereno ka sagledavanju posebnog ,,interregnuma“između uspostavljene prakse korišćenja veštačke inteligencije i njene pravne regulacije. U radu se posebno fokusiramo na analizu i istraživanje upotrebe sistema veštačke inteligencije u oblasti sprovođenja zakona. Tačnije, osvetlićemo regulatorni proces vezan za veštačku inteligenciju u EU i ukazati na specifičnosti njene upotrebe u bezbednosne i policijske svrhe, pre svega uspostavljanjem ograničenja u korist javnosti i građana, kategorizacijom upotrebe pojedinih sistema veštačke inteligencije kao zabranjeni i visokorizični. Radi se o sistemima vestačke inteligencije koji koriste tehnike pedviđanja, biometrijskog nadzora odnosno prepoznavanja lica i izvedenih biometrijskih podataka. Njihov uticaj na ljudska prava je predmet posebnog dubinskog istraživanja van ovog okvira, imajući u vidu da se nekontrolisana upotreba ovih tehnika kao deo sistema veštačke inteligencije danas može poistoveti sa posledicama bacanja ,,atomske bomba“ na čovekove slobode i prava. Osim regulatornog procesa unutar EU, ukazujemo i na potencijalnu upotrebu veštačke inteligenciju u Srbiji od strane službi za sprovođenje zakona kroz analizu pravnog okvira Republike Srbije.
